Unfortunately, the Bankruptcy Code does not allow you to discharge almost any debt connected with education. This means tuition, student loans whether private or government insured, room and board, etc.
If you are filing under Chapter 7, your student loans and educational debts are exceptions from discharge. Plan on paying them. Of course, if you eliminate your other debts, you will be able to devote your excess income to your student loans.
Social security can be garnished for student loans!
In a Chapter 13, you cannot prefer to pay your student loans by setting up a special class. Your student loans will continue to incur interest during your Chapter 13, and at the end of the Chapter 13, you will still owe that interest, unless you are paying interest to all your unsecured creditors. If you are paying less than 100% to unsecured creditors, your student loans will be much bigger at the end of your Chapter 13 than when you started.
